Political And Election Law In Arizona

Barton Mendez Soto PLLC assists local and out-of-state clients with a spectrum of progressive causes and workers’ rights issues in Arizona. We regularly partner with national groups that want to fund ballot measures, form political action committees or accomplish other goals in the political arena.

Jim Barton is highly respected as an Arizona election lawyer and the counsel of record on many key cases such as Arizona Free Enterprise v. Bennett, 131 S.Ct. 2806 (2011) and Arizona Chamber of Commerce & Indus. v. Kiley, 242 Ariz. 533, 399 P.3d 80 (2017).  He also successfully defended Proposition 127, the Clean Energy for a Health Arizona Act, during a five-day trial that involved more than 1,000 subpoenaed witnesses. In addition, he successfully defended against challenges to raising the minimum wage.

Our Advisory/Formation Services

Barton Mendez Soto PLLC provides comprehensive counsel to political parties, political action committees, ballot measure committees and Arizona non-profit organizations engaged in promoting civic engagement. From advising political parties on operational policies and assisting labor union separate segregated funds with campaign finance reporting to providing guidance on takedown letters, our firm is a trusted resource.

We work interactively with our clients to maximize the impact of resources dedicated to political activity.  This includes determining the right match between mission and the form of entity—501(c)(3), 501(c)(4) or PAC—used to complete that mission.  In every situation, we utilize proactive strategies to minimize our clients’ compliance risks and promote their objectives.

Our Litigation Services

Representing both plaintiffs/complainants and defendants/respondents, our attorneys have experience litigating campaign finance complaints, candidate petition challenges, ballot access challenges for initiatives, and related election law cases.  We both defended Arizona’s Minimum Wage Act from a challenge to its constitutionality after voters passed the measure, AND won a court ruling that the Legislature’s attempt to undermine the Act was itself unconstitutional.
